Long-established San Diego Comic-Con whipped out the big guns when they decided to sue Utah’s 3-year-old pop culture convention called Salt Lake Comic Con arguing the young convention has no claim to the “comic con” name. But Salt Lake organizers are holding steadfast in their public assertion that San Diego has no right to the name, an issue that has threatened many other smaller comic conventions across the country. One of Salt Lake Comic Con’s founders, Bryan Brandenburg opened up about the incident with Desert News claiming:

A lot of people have figured out that our case is the nexus of the 'comic con' trademark issue. It's San Diego versus everyone else.

According to the Salt Lake Comic Con organizers, many smaller conventions who have also been threatened about keeping their comic con name are coming together against San Diego Comic-Con’s claim to the name. But for San Diego who filed the lawsuit in Southern California’s U.S. District Court last year, using the moniker “comic con” in Salt Lake Comic Con’s name and promotional materials goes against their hold on the trademark “comic-con”.

Kiss frontman Gene Simmons is awaiting the signal from the U.S. Patent and Trademark Office after he filed an application Friday for a trademark on a hand gesture. Rock fans are probably familiar with the sight. Here's the drawing that's included in the application:

According to Simmons, this hand gesture was first used in commerce Nov. 14, 1974. That appears to correspond with Kiss' Hotter Than Hell tour.

Speaking of hell, the hand gesture appears quite similar to what's known as the "Sign of the horns," a devil signal that, according to an entertaining entry from Wikipedia, dates back to the 5th Century BC founder of Buddhism.

Simmons is claiming the hand gesture mark for "entertainment, namely, live performances by a musical artist; personal appearances by a musical artist."

Before the Trademark Office allows this hand gesture to be registered — it perhaps wouldn't be unprecedented — an examiner would consider the likelihood of confusion and, possibly, whether it's too generic to be associated with Simmons. You can trademark a hand signal? Stone Cold should have looked into that in the 90's.

it's hilarious that they go after the little guys thinking they'll back down from a major legal battle. But they won't tale the same legal approach against the HUGE shows like NYCC (New York Comic Con) where they rival SDCC in size and popularity!

Reed Pop may well be paying San Diego for a license, who knows? Salt Lake are run by billionaires I think so they have the $ to fight in court on principle, essentially for everybody else.

After reading a bunch on this, what's really interesting is that Salt Lake is actually countersuing to cancel SDCC's trademark. So by filing this lawsuit, SDCC might actually be shooting itself in the foot. Salt Lake's case looks very strong and they don't seem fi be backing down at all.

Hubris on the part of SDCC. Feeling they own the "Comic Con" title is laughable and I hope they're emphatically defeated in court.

When did they submit this trademark, recently? After what, 35 years of being in business?

I can't fathom seeing this go their way, but by chance it does, imagine the reactions from NYCC and RICC (two largely successful shows), along with the hundreds of other little "comic cons'!

As :greg: mentioned it's possible the larger cons already pay them a fee. Cause it doesn't make sense for them to target Salt Like City before NY

But for smaller ones, yea you're right.
